DiscoverYourTour Affiliate Program Terms

These Affiliate Program Terms (the Terms) form an agreement between you (the Affiliate, you or your) and Airotour OÜ, trading as DiscoverYourTour (DiscoverYourTour, we, us or our).

They govern your participation in the DiscoverYourTour Affiliate Program (the Program). By applying for, accessing or using the Program, you agree to these Terms.

DiscoverYourTour is an online marketplace where travellers can discover and book tours, free walking tours and local experiences. We may update these Terms from time to time. We will give at least 30 days' notice of material changes through the affiliate platform or by email, unless a shorter period is reasonably necessary for security, fraud prevention or a change in law. Changes do not reduce commission that was already validly earned before the change takes effect.

1.1 Application and approval

To join, submit an application and create an account through our affiliate platform, currently Endorsely. Approval is at our discretion. We may accept, decline, suspend or remove an application where this is reasonable to protect travellers, suppliers, the Program or DiscoverYourTour's reputation.

1.2 Eligibility

You must:

• be at least 18 years old, or the legal age of majority where you live;
• provide accurate contact, payment and tax information;
• operate an active website, newsletter, social-media channel, community, travel business or other genuine audience relevant to travel, tourism or local experiences; and
• comply with applicable law, the rules of every platform where you promote us, and these Terms.

1.3 Supplier affiliates

Approved DiscoverYourTour suppliers may also be Affiliates. A supplier may use its approved affiliate link to promote its own DiscoverYourTour listings through its website, blog, social channels or email list, provided that the promotion is transparent and complies with these Terms.

Bookings made by genuine travellers through that link may qualify for affiliate commission under section 3, including where the link promotes the supplier’s own DiscoverYourTour listing. Supplier payout terms and marketplace commission terms continue to apply separately.

1.4 Independent relationship

You and DiscoverYourTour are independent contractors. Nothing in these Terms creates an employment relationship, agency, partnership, franchise or joint venture. You may not make commitments or representations on our behalf.

2.1 Referral links

Once approved, you receive a unique tracking link and, where available, approved promotional materials. Commission is payable only for a booking correctly tracked through your affiliate link or an approved tracking method assigned to your account.

2.2 Attribution window and model

A click on your link is tracked for 30 days. We use last-click attribution: if a traveller clicks more than one affiliate link during the attribution window, the most recently clicked eligible link receives the credit. Where consent is required by applicable law, referral tracking relies on the traveller granting the relevant consent. If consent is not granted, a referral may not be tracked and commission may not be payable.

2.3 Qualifying Booking

A Qualifying Booking is a booking that:

• was made by a genuine traveller through your valid tracking link;
• is correctly attributed to your referral link in DiscoverYourTour's booking records or, for a paid tour, in Endorsely;
• is not cancelled, refunded, charged back, fraudulent, duplicate or otherwise invalid;
• has taken place, where required under section 3; and
• complies with our website terms, supplier rules and these Terms.

We decide attribution and validity reasonably, using our booking and payment records as the primary record if there is a discrepancy.

2.4 Bookings that do not qualify

No commission is payable for:

• fraudulent, artificial, automated, duplicate or test bookings;
• bookings generated through prohibited traffic or a breach of these Terms;
• bookings cancelled by the traveller or supplier, refunded, charged back or not paid where payment is required;
• bookings by you, your household or anyone acting on your behalf solely to generate commission; or
• any booking we reasonably believe has been manipulated.

3.1 Free tours

For each Qualifying Booking for a free tour, we pay €0.50 per attended traveller aged 12 or over. Children under 12 do not generate affiliate commission. A traveller is only counted once the relevant tour has taken place and the booking is recorded as attended. No commission is due for a no-show, a late cancellation, an invalid booking or a traveller removed from the booking.

Free-tour commission is calculated by DiscoverYourTour from completed bookings attributed to your referral link. It is not recorded in Endorsely. Endorsely currently tracks only the paid-tour campaign.

3.2 Paid tours and experiences

For each Qualifying Booking for a paid tour or experience, we pay 5% of Net Booking Value. Paid-tour commission is tracked in Endorsely on the 5% paid-tour campaign.

Net Booking Value means the total amount paid by the traveller for the booking, including applicable VAT and other taxes, but excluding refunds, chargebacks, credits, disputed amounts and any amount not successfully collected by DiscoverYourTour.

For bookings paid partly as a deposit, Net Booking Value means the full tour price shown to the traveller at checkout, not only the deposit paid at the time of booking.

3.3 Approval and reversals

Commission is initially shown as pending. It becomes approved after the tour or experience has taken place and after any applicable refund or dispute period. We may reverse or offset commission if a booking is later refunded, charged back, cancelled, found to be fraudulent or otherwise ceases to be a Qualifying Booking.

3.4 Payment

Approved commission is paid monthly, by the 15th of the following month, once your approved balance reaches €25.00. Balances below €25.00 will roll over until the payment threshold is reached. Available payment methods are shown in your affiliate account. You are responsible for your own bank charges, currency conversion costs and taxes.

All commission is calculated and paid in EUR. Any currency conversion or payment-provider charges are the Affiliate’s responsibility.

3.5 Tax and payment information

You must provide accurate payment and tax information when requested. We may delay payment until the required information has been provided, or where withholding is required by applicable law.

3.6 Payment queries

Please raise a commission or payment query through [email protected] within 30 days of the payment or statement date. We will investigate it reasonably using the Program records.

4.1 Permission

During your participation in the Program, you may use DiscoverYourTour's approved name, logo and promotional materials solely to promote DiscoverYourTour and your affiliate link.

4.2 Restrictions

You must not:

• alter our logos or present yourself as DiscoverYourTour or as an employee or agent of DiscoverYourTour;
• register or use a domain, social handle, app name or business name that includes "DiscoverYourTour" or a confusingly similar variation;
• copy our website, booking flow, social accounts or visual identity in a misleading way; or
• use our name or materials alongside unlawful, offensive, deceptive or infringing content.

All goodwill from use of our brand belongs to DiscoverYourTour. We can withdraw brand permission at any time.

5.1 Allowed promotion

You may promote DiscoverYourTour through genuine content and audiences you control, including travel articles, destination guides, reviews, videos, social posts, newsletters to an opted-in audience, podcasts, communities and supplier websites.

5.2 Affiliate disclosure

You must make your affiliate relationship clear before or next to the affiliate link. For example:

“This page contains affiliate links. If you book through them, I may earn a commission at no extra cost to you.”

You are responsible for following all consumer, advertising and disclosure laws that apply to your audience, including EU/UK rules and FTC endorsement requirements where relevant.

5.3 Paid advertising

Without our written permission, you must not bid on, target or use DiscoverYourTour, common misspellings, close variations or our domain in paid-search keywords, ad copy, display URLs or ad extensions. You may not run advertising that makes it appear that you are DiscoverYourTour.

5.4 Prohibited practices

You must not:

• use cookie stuffing, forced clicks, auto-redirects, pop-ups, pop-unders, iframe injection or hidden links;
• mask or falsify referral information;
• use browser extensions, toolbars, adware or software that injects, rewrites or automatically activates links;
• send unsolicited bulk email, use bought or scraped contact lists, or spam direct messages;
• submit links to coupon, cashback or deal websites without our written approval;
• make false, misleading or unverified claims about tours, availability, prices, cancellation terms, suppliers or traveller outcomes;
• create fake traffic, fake accounts, fake bookings or fake reviews, whether manually, through automation or through AI; or
• offer unapproved cashback, rebates, discounts, vouchers or incentives funded from your commission.

5.5 Respect for travellers and suppliers

Do not publish inaccurate safety, accessibility, availability, price or itinerary information. Where you mention a particular tour, link to the current DiscoverYourTour listing and make clear that tour information and availability can change.

We may monitor referral links, traffic patterns and publicly visible promotional activity to verify compliance. We may ask for reasonable information about the source of your referrals; you must respond within 10 business days.

We may withhold commission temporarily while investigating suspected fraud or a material breach. If the breach or fraud is confirmed, we may reject or reverse affected commission and suspend or end your participation immediately.

Either you or DiscoverYourTour may end participation in the Program at any time by written notice. We may suspend or terminate participation immediately for fraud, suspected fraudulent or artificial bookings, breach of these Terms, unlawful promotion, failure to disclose the affiliate relationship, brand misuse or conduct that could harm travellers, suppliers or DiscoverYourTour.

When participation ends, you must promptly stop using affiliate links, the DiscoverYourTour name and all Program materials. We will pay valid, approved commission earned before termination in the ordinary payment cycle, unless termination resulted from fraud or a material breach, in which case unpaid affected commission may be withheld or forfeited as permitted by law.

Nothing in these Terms limits liability that cannot legally be limited. Subject to that, DiscoverYourTour is not responsible for indirect or consequential losses, loss of profits, loss of goodwill or loss caused by factors outside our reasonable control.

You are responsible for your own promotional activities, legal compliance and content. You will indemnify DiscoverYourTour, its affiliates, directors, employees and suppliers against third-party claims, losses and reasonable costs arising from your breach of these Terms, your unlawful promotion or your infringement of third-party rights.

9.1 Notices

We may send Program notices to the email address in your affiliate account or display them in the affiliate platform. Send notices to [email protected].

9.2 No waiver and severability

If we do not enforce a provision immediately, that does not waive it. If a provision is unenforceable, the remaining provisions continue to apply.

9.3 Assignment

You may not transfer your Program account or these Terms without our written consent. We may transfer these Terms as part of a merger, acquisition, restructuring or sale of assets.

9.4 Governing law and jurisdiction

These Terms are governed by the laws of Estonia. The courts of Tallinn, Estonia have exclusive jurisdiction, unless mandatory consumer or other applicable law requires otherwise.
